Council must either approve (generally with conditions) or refuse a DA.
Who can determine development applications?
Council officers can determine simple applications under ‘delegated authority’ without the need to report to a Council meeting.
A development application will be referred to Council in circumstances where:
- The estimated cost of the proposed development exceeds $10Million
- The proposed development involves significant departures from Council’s adopted guidelines or policies
- A Councillor makes a written request for the application to be determined by Council
- The Director of Planning and Regulation considers that there is a broader public interest best suited to Council determination
The Council can defer, approve or refuse items based on a simple majority vote.
How is the applicant notified of a Determination of a development application?
You will be sent a formal Notice of Determination advising whether your development application has been approved or refused.

Any approval of development (consent) will generally be subject to conditions.
Failure to undertake development in accordance with any conditions of consent is illegal and may give rise to legal action.
